The Promotion is organized by Tommy Hilfiger Europe B.V. a private limited liability company construed under the laws of the Netherlands (the “Promoter”) and will be governed by these terms and conditions (the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”.

PROMOTION TERMS

GENERAL TERMS AND CONDITIONS FOR PRIZE PROMOTIONS

1. The Promotion is organized by Tommy Hilfiger Europe B.V. a private limited liability company construed under the laws of the Netherlands with registered office address at Danzigerkade 165, 1013 AP, Amsterdam, the Netherlands, company registration number 33290078 (the “Promoter”) and will be governed by these terms and conditions ((the “General Terms”) and the additional terms for the specific promotion (“Promotion Terms”), together the “Terms”). Tommy Hilfiger Europe B.V. is the independent controller for all processing of personal data collected for the purpose of the Promotion and will process the personal data in accordance with our privacy notice (available at: https://sk.tommy.com/terms-and-conditions#PRIVACY_NOTICE).

2. A consumer entering the Promotion (hereinafter called “Participant”) agrees to have read and understood the Terms and will be bound by them. The Promotion Terms shall prevail over the General Terms.

3. The Promotion will run in the Region specified in the Promotion Terms. The Promotion shall be void where or in as far as prohibited or restricted by law.

4. By participating in this Promotion during the Promotional Period, Participants have a chance to win the Prize. The Promotional Period, the Prize and its value is further specified in the Promotion Terms. The prize award is non-transferable and no cash redemption or prize substitution allowed, except at Promoter’s sole discretion or as provided herein. No cash alternatives for the Prize will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the Prize or any part of it, the Promoter reserves the right to award a substitute prize of equal or greater value.

5. In addition to the the participation criteria set out in the Promotion Terms, the Participant has to enter the Promotion by agreeing to the Terms and has to be at least twenty one (21) years of age at the date of entry of the Promotion. The Promotion is not open – directly nor indirectly – to employees and immediate relatives of employees of the Promoter, its subsidiaries or affiliated companies, or any other person professionally connected with the Promotion.

6. The winner, if a tax resident in the Slovak Republic, is responsible for taxing the amount of the non-monetary and monetary prize that is not subject to personal income tax exemption through his/her tax return. The Winner, if a tax resident in the Slovak Republic, is also responsible for any health levies or other levies and/or charges that are due and payable on his/her non-monetary and monetary winnings in the Slovak Republic.

7. Any Winner will be informed of the fact that they won via an email from the Promoter to the email address shared by the Participant and the first name and city of residence of the Winner will be published on the https://sk.tommy.com/nyc-trip-2024-raffle that communicates the Promotion.

8. Unless otherwise stated in the Promotion Terms, the Participants will be ranked in order to select the Winner. Those who follow in the ranking, after the first name or winner, will be considered reserves in order of ranking in case of unavailability of the winners or in the absence of the required requirements. The Winner needs to respond to the Promoter within 14 days after the first notification to confirm his/her acceptance of the prize. If such response has not been received by the Promoter within the said time, the Promoter has the right to choose another Winner applying the ranking order. The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable grounds for believing that a selected Winner has contravened any of these Terms. Any alternative Winner will be selected applying the same criteria as that used to select the original Winner.

10. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to this Promotion.

11. No waiver of any rights by the Promoter or any Participant will be taken as a waiver of any other rights it may have. For example, if the Promoter waives its right to complain about a particular breach of the Terms by a Participant, it does not prevent the Promoter from complaining about other breaches.

12. Any personal data collected by Promoter from Participants (e.g. name of Winner), will be used solely in connection with this Promotion in accordance with our privacy notice (available at: https://sk.tommy.com/terms-and-conditions#PRIVACY_NOTICE).

13. The Terms shall be governed by and construed in accordance with the laws of the Netherlands, unless mandatory local laws prevail and any disputes shall be subject to the jurisdiction of the competent courts in Amsterdam, the Netherlands, unless mandatory local laws prevail.

14. The authority authorized to settle out-of-court consumer disputes arising in connection with the participation of the Participant, being a consumer, in this Promotion is the Slovak Trade Inspection. On the website (http://www.soi.sk/) the Participant will find, among other things, information on the method and conditions of out-of-court dispute resolution, while out-of-court dispute resolution can only be initiated on the basis of a proposal of the Participant and after he fails to resolve the dispute directly with the Promoter. The form of the proposal for initiation of out-of-court settlement of a consumer dispute is available on the website of the Slovak Trade Inspection.

15. The Participant, being a consumer, has the right to initiate an out-of-court dispute resolution online through the ODR platform available on the website https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.trader.register&lng=EN.The Promotion Terms and General Terms will be made available at https://sk.tommy.com/nyc-trip-2024-raffle-terms-conditions.
